the roms are illegal unless you have had the game then its legal
technically speaking the company are not selling the game (AT least for SNES) any more so they are not gaining/losing any money from you downloading it - I doubt Squire Enix would care really unless you downloaded the DS version then of course they would.
However what you said about new games is correct, If you already own it they really can't do anything about you downloading it.
